Significant increase in Court fees for landlords to regain possession of their properties

An unexpected announcement about an increase in Court fees has shocked landlords and letting agents alike.

Thanks to Landlord Law for providing us with the low down:

Court fees will be going up on 22 April. The court fee for eviction proceedings for example will go up from £175 to £280 and the PCOL fee (the possession claims online service used for rent arrears claims only) will go up to £250.

Other changes are:

>> the introduction of a generic issue fee (£280) for all non-money cases across the civil court syste
>> increases to issue fees for money claims with a value of over £1,500
>> increases in small claims track hearing fees
>> the introduction of the same general application fees across the civil court system, including family proceedings
>> increases to fees charged in judicial review proceedings from £60 to £140 for an application for permission and from £215 to £700 for a hearing or oral renewal application

In a recent blog we reported how our very own Stuart Williams, of Northwood Dulwich, was approached by Channel 4 to appear in an item about Government plans to speed up the eviction process.

One of the main points that Stuart wanted to get across was the fact that, of the entire “eviction process”,  most of the time is taken up waiting for the Courts to do their job, not waiting for the rent arrears to reach the level when the process can be started.

So landlords looking to get their cases in before the price rises are potentially going to clog up the Courts further.

This is a rough outline of the current time scale:

Timescale for tenancy breach:

4 – 8 weeks

Section 8 notice period:

2 – 8 weeks

Period for court hearing:

6 – 8 weeks

Standard repossession order period:

4 weeks

Bailiffs’ Warrant:

8 weeks
